Terms and Conditions

Effective Date: October 10, 2026

1. Introduction

Welcome to Hypreom. By installing, accessing, or using our telematics, IoT asset tracking, and vehicle security systems, you agree to comply with and be bound by the following terms and conditions. If you do not agree to these terms, please do not use our services.

2. Scope of Services

Hypreom provides enterprise-grade telematics, loss prevention systems, and security hardware designed to monitor, track, and secure vehicle fleets and assets. While our systems employ industry-leading technology to mitigate risks such as unauthorized use and fuel siphoning, they are intended as precautionary tools and do not guarantee the absolute prevention of theft, loss, or damage.

3. Installation and System Usage

All security and telematics hardware must be installed by authorized Hypreom technicians or certified partners. Any unauthorized installation, tampering, or modification of the hardware will void all warranties and release Hypreom from any liability related to system failure or operational inaccuracies.

Users are responsible for ensuring that the operation of the vehicle and the installed systems complies with all applicable local, regional, and national laws, including data privacy regulations.

4. Limitation of Liability

To the maximum extent permitted by applicable law, Hypreom shall not be held liable for any direct, indirect, incidental, special, or consequential damages resulting from:

  • The use or inability to use our services and tracking hardware.
  • Any unauthorized access to, alteration of, or destruction of your data due to circumstances beyond our control.
  • The theft, loss, or damage of any vehicle or asset, notwithstanding the installation of Hypreom security systems.
  • Service interruptions caused by failures in telecommunications networks, GPS satellite downtime, or power supply issues.

5. Acceptance of Risk and Indemnification

By utilizing Hypreom security and tracking systems, the customer acknowledges and explicitly accepts all inherent risks associated with asset management and vehicle security. The customer agrees to indemnify, defend, and hold harmless Hypreom, its directors, employees, and agents from any claims, liabilities, damages, and expenses (including legal fees) arising out of or related to the customer’s misuse of the system, breach of these terms, or violation of any third-party rights.

6. Data Privacy and Telematics Monitoring

The collection and processing of operational data, including geospatial telemetry and engine diagnostics, are governed by our Privacy Policy and are conducted in strict compliance with the Protection of Personal Information Act (POPIA). By using our services, you consent to the collection and use of this data for service provisioning, audit compliance, and system optimization.

7. Warranty Limitations

Hypreom hardware is provided “as is” and “as available” without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose.

8. Governing Law

These terms and conditions shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in South Africa.
